Simon Abraham's Terms of Service

These Terms of Service ("Terms") govern your access to and use of all products, applications, websites, and services provided by Simon Abraham Works ("we," "us," or "our"), including but not limited to apps published on the Wix App Market and associated backend services (collectively, the "Services").

By installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Use of Services

You may use the Services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use complies with all applicable laws and regulations. You may not use the Services to violate any third-party rights or any policies of platforms through which the Services are accessed (including Wix and Google).

No Warranties — Services Provided AS IS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the Services will meet your specific business requirements or produce any particular result.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIMON ABRAHAM WORKS, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) USD $50.

Third-Party Dependencies

The Services depend on third-party platforms including Google LLC and Wix.com Ltd. We are not responsible for any unavailability, errors, changes, or policy modifications made by these third parties that affect the functionality of our Services. We will make commercially reasonable efforts to restore functionality when third-party changes impact the Services, but we make no guarantee as to timeline or outcome.

Subscription and Billing

Access to certain features may require a paid subscription. Subscriptions are billed in advance on a recurring basis. If you cancel or your subscription expires, access to paid features will be disabled at the end of the current billing period. Fees paid are non-refundable except as required by applicable law.

Service Interruptions and Bug Fixes

We will make commercially reasonable efforts to resolve confirmed bugs and restore interrupted service. We do not guarantee any specific response time or resolution timeline. The Services may be modified, suspended, or discontinued at any time with or without notice.

Indemnification

You agree to indemnify, defend, and hold harmless Simon Abraham Works and its owners, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content or data you submit through the Services.

Intellectual Property

All content, code, branding, and materials provided as part of the Services are the property of Simon Abraham Works or its licensors and are protected by applicable intellectual property laws. You may not copy, reverse engineer, modify, or distribute any part of the Services without our prior written consent.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Mexico City, Mexico, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Mexico City, Mexico.

Changes to These Terms

We may update these Terms at any time. We will indicate the updated date at the top of this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.
